Because surrogacy is a relatively new practice in conceiving a child, many of the laws and regulations surrounding it either have not been fully formed (the subject hasn’t been tested in state courts yet), or are explicit in that they don’t honor surrogacy contracts at all. Since statutes and case law are different in every state, regardless of where the agency is, carriers must reside in states where commercial surrogacy is not prohibited.
Many states, including New York, Indiana, the District of Columbia, and Michigan, explicitly state that surrogacy contracts are unenforceable and against public policy. Other states, like Iowa, seem to implicitly accept surrogacy agreements, but no statute directly addresses the topic. Still others allow certain types of surrogacy but appear not to allow them for gay and lesbian couples (Florida, Texas, and Utah to name a few).
One state that has been proven to be LGBT friendly when it comes to surrogacy agreements in California, since California’s courts have used the state’s Uniform Parentage Act to interpret several cases concerning surrogacy agreements, according to the HRC. For this reason, and because the only legitimate listing we could find of vetted surrogacy agencies comes from the well-known gay dad group The Pop Luck Club, many of the agencies listed below are anchored in California. While there are scattered surrogacy agencies throughout the Northeast, and some with offices in New York, it’s best to do your homework and ask questions yourself when choosing a surrogacy or egg donor agency.
